Court to consider if Taber funds can be used for Urbanna pool

A Middlesex County Circuit Court judge is to consider if the Town of Urbanna can borrow $500,000 from the “Charles Wellington Taber Fund” principal to be used to build a new community swimming pool.

The petition that is to be decided by the court states: “The Town respectfully requests that the Court authorize the Town to withdraw the amount of $500,000 from the corpus or principal of the Taber Trust to be used as a portion of the funding needed for the construction or reconstruction of a pool at Taber Park in the Town of Urbanna with the requirement that the $500,000 shall be repaid by the Town to the corpus or principal of the Taber Trust in whatever manner and timeframe the Court deems appropriate and that the Court grant any and all such other relief as the Court may deem necessary.”

Urbanna Town Council member Larry Chowning, who served on town council in the early 1980s, said in May the town’s requests to withdraw principal from the Taber Trust has been turned down by the court before.

According to the town’s petition, Dr. Taber’s will provides for change in how the income is spent and in part states, “To expend the income therefrom, through such agencies as the Circuit Court of Middlesex County, Virginia, may direct to be created or appointed, for the acquisition and operation of. . .’” …
