Supervisors want planners to make solar recommendations

County attorney Heather Lewis informed the Middlesex County Board of Supervisors (BOS) on July 2 that supervisors do not have the authority to enact a moratorium on solar construction while waiting for zoning recommendations from the planning commission. 

Harmony Village supervisor Kathleen Swinehart suggested she wanted the board to “pause” the process until October 15 when the planning commission has had enough time to review county solar ordinances.

During a “housing boom crisis,” Lewis said that Fairfax County attempted to put a moratorium on subdivisions but the Virginia Supreme Court ruled that the county could not pause the process while determining zoning policies. “My advice to you at this time is not to make a motion to establish a moratorium on solar,” said Lewis.

Holt said, “We need to alert the planning commission we want to move on this matter with urgency!”
