In execution of a certain deed of trust dated December 15, 2005, in the original principal amount of $109,453.11 recorded in the Clerk’s Office, Circuit Court for Middlesex County, Virginia, in Instrument No. 050003619, default having occurred in the payment of the Note thereby secured and at the request of the holder, the undersigned Substitute Trustee will offer for sale at public auction on the front steps of the Circuit Court, Middlesex County, Route 17 and 33, Saluda, VA 23149, on August 17, 2010, at 1:00 PM, the property described in said deed of trust, located at the above address, and more particularly described as follows:
THE FOLLOWING DESCRIBED PROPERTY TOGETHER WITH ALL RIGHTS, WAYS, EASEMENTS, PRIVILEGES, AND APPURTENANCES, TO-WIT: ALL OF THAT CERTAIN TRACT OR PARCEL OF LAND SITUATED IN JAMAICA MAGISTERIAL DISTRICT, MIDDLESEX COUNTY, VIRGINIA, CONTAINING 3 1/8 ACRES, MORE OR LESS, THE LAND HEREBY CONVEYED LIES ON THE WEST SIDE OF THE OLD ROAD LEADING FROM LAGRANGE MILL TO CHURCH VIEW AND IS BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A STOB NEAR WHERE THE ROAD FROM LAGRANGE MILL FORKS, ONE TO WATER VIEW AND THE OTHER TO CHURCH VIEW, THENCE IN A NORTH WEST DIRECTION 7.25 CHAINS TO ANOTHER STOB, THENCE S 4 3/4 W 8.25 CHAINS TO THE ROAD LEADING TO CHURCH VIEW, THENCE ACROSS SAID ROAD N 83 1/2 E 3.88 CHAINS TO A TURN IN SAID ROAD, THENCE STILL ALONG SAID ROAD N 35 E 3.96 CHAINS TO THE PLACE OF BEGINNING, LESS AND EXCEPT THAT CERTAIN PARCEL OF LAND CONVEYED TO THE COMMONWEALTH OF VIRGINIA BY INSTRUMENT RECORDED IN THE CLERK’S OFFICE OF THE CIRCUIT COURT OF MIDDLESEX COUNTY IN DEED BOOK 81, PAGE 539. LESS AND EXCEPT THAT CERTAIN PARCEL OF LAND CONVEYED TO HELEN L. REDMON BY DEED DATED APRIL 15, 1974 AND RECORDED IN THE AFOREMENTIONED CLERK’S OFFICE IN DEED BOOK 101, PAGE 172. TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser’s sole remedy, in law or equity, shall be the return of his deposit without interest.
