Default having been made in the terms of a certain Deed of Trust dated October 31, 2007, in the original principal amount of $160,547.00 and recorded in the Clerk’s Office of the Circuit Court of the County of Middlesex, Virginia in as Instrument No. 070002747, the undersigned Substitute Trustees, will sell at public auction on April 22, 2009, at 9:30 a.m., in front of the building housing the Middlesex County Circuit Court, Courthouse, Routes 17 and 33, Saluda, VA, the property designated as containing 4.272 acres, more or less, for a more accurate and particular description as to the metes and bounds of the property, reference is made to a plat of survey prepared by John T. TOGETHER WITH a perpetual, non-exclusive easement of right of way, over, across and upon all of the roadways and dumpster easement, shown on the hereinbove mentioned plat of survey for reasonable ingress and egress to and from the property hereby conveyed out to State Route 703.
Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises. TERMS: CASH. A deposit of $16,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $10,000 of cash will be accepted. The successful bidder’s deposit will be retained at the sale and applied to the sale price.
