In execution of a Deed of Trust dated June 30, 2004 and recorded in the Clerk’s Office of the Circuit Court of Essex County, Virginia in Deed Book 295, page 62 (the “Deed of Trust”), default having been made in the payment of the debt therein secured and in the performance of covenants therein contained, and being requested to do so by the holder of the note secured thereby (“Beneficiary”), the undersigned Substitute Trustee (“Trustee”), after giving not less than 14 days notice to the owner of the property described below by certified mail, return receipt requested, of the date, time, place and terms of sale, will offer for sale the property described below at public auction on the front steps of the Circuit Court of Essex County, Virginia, located at 305 Prince Street, Tappahannock, Virginia on Friday, September 11, 2009, at 2:00 p.m. (local time). TERMS OF SALE: Cash. Settlement within 30 days of the sale, time being of the essence. The Property shall be sold “AS IS, WHERE IS, AND WITH ALL FAULTS,” with no representations or warranties of any kind and subject to all recorded or unrecorded matters of title prior to the lien of the Deed of Trust.
