In execution of a Deed of Trust, dated August 5, 2005 recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia in Deed Book 418, at Page 6 granting and conveying property therein described in trust to Elizabeth B. Hurd and Charles W. Paul, Trustees, the undersigned Trustee will offer for sale at public auction on April 22, 2009, at 12:00 noon, at the front entrance of the new Middlesex County Circuit Court Building, 73 Bowden Street, Saluda, VA 23149, the real estate lying in Middlesex County, Virginia and more particularly described as follows:
All that certain lot, piece or parcel of land, with all improvements thereon, situated in Saluda Magisterial District, Middlesex County, Virginia, and containing 4.348 acres. For a more accurate and particular description as to the metes and bounds of the property hereby conveyed, reference is made to a plat of survey prepared by Robert C. Buckley, Jr., L.S., entitled “Plat Showing Lots 1-5 Healy’s Trace Subdivision, Located in the Saluda District of Middlesex County, Virginia”, dated November 30, 1993, revised January 17, 1994, and further revised February 25, 1994, a copy of which plat is recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, in Plat Book 12, Page 82, whereon said plat the property is shown and designated as “Lot 2, Healy’s Trace Subdivision” and to which reference is hereby made for a more particular description of the property herein conveyed.
TOGETHER WITH a perpetual, non-exclusive easement of right of way, which is to be appurtenant to the property herein described and to be used in common with all others legally entitled to the use thereof, fifty (50’) in width, running from State Route #620 in a southerly then easterly direction and shown on the above-mentioned Buckley plat as “Healy’s Run Drive,” and thence continuing in an easterly direction from the easternmost portion of Healy’s Run over the northern portion of Lot 13 of Healy’s Run Subdivision and Lot 5 of Healy’s Trace Subdivision designated on the above-mentioned Buckley plat as “50’ Easement of R/W for Ingress and Egress Purposes.”
SUBJECT TO a twenty-five foot (25’) wide easement of right of way parallel to the southern property line of the property hereby conveyed for purposes of ingress and egress over Healy’s Run Drive to State Route 620 for the benefit of Lots 2, 3, 4, and 5 of Healy’s Trace Subdivision as shown on the said Buckley plat.
The property shall be sold “AS IS” and the sale is subject to all restrictions, rights of way, conditions, easements, judgments, liens, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust, and to the real estate taxes from the date of the sale.
TERMS OF SALE: All cash. A deposit of $2,500.00 cash or by bank cashier’s check payable to the Trustee will be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the trustee’s compensation authorized by the deed of trust and the law in such cases.
Conveyance of the property shall be by trustee’s Special Warranty Deed. Except for the statutory grantor’s tax paid by the trustee, all costs of conveyance, including, but not limited to, examination of title, recording fees, and settlement fees, shall be at the cost of the purchaser.
The trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.

A public hearing will convene at 9:30 a.m. on Tuesday, April 28, 2009, at the office of the Virginia Marine Resources Commission (VMRC), 2600 Washington Avenue, 4th floor, Newport News, to review an application submitted by TriCounty Farms seeking authorization from VMRC to remove an existing timber jetty and breakwater and to construct a 100-foot long timber jetty, a 290-foot long open-pile pier with an attached wave baffle, 50 linear feet of timber bulkhead and a 10-foot wide by 32-foot long floating pier. In addition they seek authorization to initially dredge and excavate a total of 416 cubic yards of sandy subaqueous and beach material from a 50-foot by 75-foot area adjacent to the proposed bulkhead to provide maximum depths of minus three (-3) feet at mean low water and to maintenance dredge the area on an as-needed basis for a five (5) year period with the sandy dredged material proposed to be placed along the intertidal beach immediately downdrift (southeast) of the boat launch area adjacent to the B.E.S.T. boatyard facility situated along the Rappahannock River off State Route 639 in Middlesex County. The project will require a Coastal Primary Sand Dune/Beach permit and a subaqueous permit.
