In execution of a Deed of Trust, dated November 22, 2005 recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia in Deed Book 425, at Page 583 (as modified by Modification Agreement to Note and Deed of Trust dated August 9, 2010 and recorded as document number 10-1522 in the aforesaid Clerk’s Office) granting and conveying property therein described in trust to David W. Hicks, Sr. and Karen A. Hicks Trustees, the undersigned Trustee will offer for sale at public auction on September 16, 2011, at 12:00 noon, at the front entrance of the new Middlesex County Circuit Court Building, 73 Bowden Street, Saluda, VA 23149, the real estate lying in Middlesex County, Virginia and more particularly described as follows:
All that certain lot or parcel of land with all improvements thereon, all rights, ways, easements, privileges and appurtenances thereunto belonging or in any way appertaining, situated in the Saluda Magisterial District, Middlesex County, Virginia known and designated as Lot 6, containing 3.855 acres, more or less and shown on Plat of Subdivision entitled, “Subdivision Survey of 30.867 acres”, prepared by Dalton D. Brownley, Jr., Land Surveyor, dated October 10, 2005 and recorded in Deed Book 423, at Page 770 in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, to which reference is made for an accurate description of the metes and bounds of the property hereby conveyed.
TOGETHER WITH an appurtenant easement of ingress/egress over the existing 50’ wide right-of-way from the property to Whiting Creek Drive, which is described in that Deed recorded in Deed Book 191, at Page 469 and shown on Plat of Survey recorded in Plat Book 10 at Page 174 and an appurtenant easement of ingress/egress over the roads in the Subdivision as shown on the Plat recorded in Deed Book 423 at Page 770.
The property shall be sold “AS IS” and the sale is subject to all restrictions, rights of way, conditions, easements, judgments, liens, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust, and to the real estate taxes from the date of the sale.
TERMS OF SALE: All cash. A deposit of $10,000.00 cash or by bank cashier’s check payable to the Trustee will be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the trustee’s compensation authorized by the deed of trust and the law in such cases.
Conveyance of the property shall be by trustee’s Special Warranty Deed. Except for the statutory grantor’s tax paid by the trustee, all costs of conveyance, including, but not limited to, examination of title, recording fees, and settlement fees, shall be at the cost of the purchaser.
The trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.

The object of this suit is to terminate the residual parental rights of the unknown father of Kevin McClung Burrell, Jr, including, but not limited to, the termination of the right to visitation, to consent to adoption, the right to determine religious affiliation, and the responsibility for support.
It is ORDERED that the Unknown father of Kevin McClung Burrell, Jr., appear at the above-named Court and protect his or her interests on or before October 12, 2011 at 1:00p.m.

Brooks, offer for sale at public auction, at the steps of the King & Queen County Court, King & Queen, Virginia, on the 23rd day of September, 2011 at 12:00 noon, the following described property:
All that certain lot or parcel of land containing 2.189 acres and shown as Lot 4 on “Plainview Acres”, prepared by Dillard & Mason, P.C., Certified Land Surveyors, Tappahannock, Virginia, dated April 16, 1988, a copy of said plat being recorded in the Clerk’s Office of the Circuit Court of King and Queen County, Virginia in Plat Book 14, page 23 and 24, to which plat of survey reference is made for a more accurate and particular description of the land hereby conveyed.
More commonly known as 4516 Buena Vista Road, Saluda, VA.
Subject, however, to all easements, conditions and restrictions of record affecting said property.
It being the same property conveyed to John B. Oliver and Linda D. Morgan by deed of John B. Oliver, dated July 14, 2005, and recorded in the Clerk’s Office of the Circuit Court of King & Queen County, Virginia, in Deed Book 227, page 226.
