Pursuant to the terms of a certain Deed of Trust, in the original principal amount of $80,000.00, dated July 28, 2006, and recorded in the Clerk’s Office of the Circuit Court of Middlesex, Virginia (the “Clerk’s Office”), as Instrument Number 060002062, default having been made in the payment of the note thereby secured, the undersigned Sole Acting Substitute Trustees, pursuant to the request of the holder of the Note thereby secured, will offer for sale at public auction outside of the Middlesex Circuit Court, located at Routes 17 & 33, Courthouse, Saluda, VA 23149 on August 12, 2013 at 11:00 AM, the property briefly described as 8148 GENERAL PULLER HWY., TOPPING, VA 23169, and more particularly described in said Deed of Trust as follows:
All of that certain piece, parcel, or tract of land, together with all improvements thereon, situated in Pinetop Magisterial District, Middlesex County, Virginia, near Harmony Grove Baptist Church, lying on the West side of State Route #33, and containing 1.79 acres. For a more accurate and particular description as to the metes and bounds of the property hereby conveyed, reference is made to plat of survey prepared by R. B. Cartwright, C.L.S., dated January 19, 1974, recorded in Deed Book 108 at page 319 in the Clerk’s Office of the Circuit Court, Middlesex County, Virginia. Said property is bounded on the North and West by land now or formerly of Charles E. Carlton; on the South by land now and formerly of James Thorne; and, on the East by State Route #33, all as shown on said plat.
Being the same property acquired by the Grantor from Hannah L. McGhee by Deed dated July 28, 2006, and recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia immediately prior hereto, with improvements thereon.
TERMS OF SALE: Cash. A ten percent (10%) bidder’s deposit in cash or certified check payable to the Trustee(s) shall be required of the successful bidder at the time of sale before the bidding will be closed; settlement must be made within twenty (20) days from the date of sale or property to be resold at cost of defaulting purchaser. All costs of conveyancing, examination of title, recording charges, etc. will be at cost of purchaser. Neither the Substitute Trustees, nor any other party guarantees or covenants to deliver, or in any way, to obtain possession of the premises for any third party purchaser.
