TERMS OF SALE: The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale. A deposit of $5,000.00, or 10% of the sale price, whichever is lower, in cash or cashier’s check payable to the SUBSTITUTE TRUSTEE will be required at the time of sale. The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale. In the event of default by the successful bidder, the entire deposit shall be forfeited and applied to the costs and expenses of sale and Trustee’s fee. All other public charges or assessments, including real property taxes, water/sewer charges, ground rent, condo/HOA dues or assessments, whether incurred prior to or after the sale, and all other costs incident to settlement to be paid by the purchaser. In the event taxes, any other public charges or condo/HOA fees have been advanced, a credit will be due to the seller, to be adjusted from the date of sale at the time of settlement. Purchaser agrees to pay the Seller’s attorneys at settlement, a fee of $295.00 for review of the settlement documents.

In execution of and pursuant to the terms of a deed of trust, dated October 25, 2002, in the original principal amount of $250,000.00 and recorded November 14, 2002 in the Clerk’s Office of the Circuit Court for the County of Middlesex, Virginia (the “Clerk’s Office”), Deed Book 351, Page 798 (the “Deed of Trust”), the undersigned trustee(s) or either of them will offer for sale at public auction the property briefly described below, and more particularly described in the Deed of Trust:
All that certain tract or parcel of land situated in the Saluda Magisterial District, Middlesex County, Virginia, near Remlik, lying on LaGrange Creek and containing sixty-seven hundredths (.67) of an acre, more or less.
The land hereby conveyed fronts a distance of one hundred (100) feet on LaGrange Creek and extends back there from in a southerly direction between parallel lines a distance of two hundred ninety (290) feet to the northern edge of a private road, and is bounded as follows: north by mean low water mark of LaGrange Creek; east by the land now or formerly belonging to Mildred W. Nelson; south by the aforementioned private road; and west by other land now or formerly owned by W. L. Johnson.
Together with an easement of right of way over the said private road which is the southern boundary of the property to State Route No. 656 as a means of ingress and egress to the lot or parcel described hereinabove.
Being the same real estate conveyed to Andrew G. Bury, Jr., Trustee for the Rogers Trust dated June 16, 2000 by Deed of Gift from George Thomas Green dated June 21, 2000, recorded June 22, 2000 in the aforesaid clerk’s office in Deed Book 309, page 334. PURPOSE OF NOTICE: To seek public comment on a draft permit from the Department of Environmental Quality that will allow the release of treated wastewater into a water body in Middlesex County, Virginia.

PROJECT DESCRIPTION: Norview Acquisition, LLC has applied for reissuance of a permit for the private Norview Marina. The applicant proposes to release treated sewage wastewaters from the facility at a rate of 20,000 gallons per day into a water body. Sludge from the treatment process will be disposed of by a licensed contract hauler. The facility proposes to release the treated sewage in Broad Creek in Middlesex County in the Rappahannock River watershed. A watershed is the land area drained by a river and its incoming streams. The permit will limit the following pollutants to amounts that protect water quality: organic matter and solids. This facility is subject to the requirements of 9 VAC 25-820 and has registered for coverage under the General VPDES Watershed Permit Regulation for Total Nitrogen and Total Phosphorus Discharges and Nutrient Trading in the Chesapeake Bay Watershed in Virginia. As a condition of this permit, the permittee will be required to offset in advance of commencement of discharge, any loads of total nitrogen or total phosphorus that are expected to be discharged in a given calendar year.
HOW TO COMMENT AND/OR REQUEST A PUBLIC HEARING: DEQ accepts comments and requests for public hearing by e-mail, fax or postal mail. All comments and requests must be in writing and be received by DEQ during the comment period. Submittals must include the names, mailing addresses and telephone numbers of the commenter/requester and of all persons represented by the commenter/requester. A request for public hearing must also include: 1) The reason why a public hearing is requested. 2) A brief, informal statement regarding the nature and extent of the interest of the requester or of those represented by the requester, including how and to what extent such interest would be directly and adversely affected by the permit. 3) Specific references, where possible, to terms and conditions of the permit with suggested revisions. A public hearing may be held, including another comment period, if public response is significant, based on individual request for a public hearing, and there are substantial, disputed issues relevant to the permit.
