In execution of a certain deed of trust dated December 22, 2008, in the original principal amount of $510,000.00 recorded in the Clerk’s Office, Circuit Court for Middlesex County, Virginia, in Instrument No. 080002807, default having occurred in the payment of the Note thereby secured and at the request of the holder, the undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Middlesex County, Route 17 and 33, Saluda, VA 23149, on November 08, 2013, at 2:30 PM, the property described in said deed of trust, located at the above address, and more particularly described as follows: ALL THAT CERTAIN LOT OR PARCEL OF LAND SITUATE IN SALUDA MAGISTERIAL DISTRICT, MIDDLESEX COUNTY, VIRGINIA, LYING IN THE VILLAGE OF SALUDA ON FORRER STREET, CONTAINING 0.60 ACRE +/-, AND SHOWN AND DESCRIBED AS LOT #1 ON A PLAT OF SURVEY PREPARED BY FRANK E. TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. ORDER OF PUBLICATION
The object of this suit is to enforce the lien of the Complainant, County of Middlesex, Virginia, for delinquent real estate taxes against certain real property located in County of Middlesex, Virginia, described as follows:
Tax Map No. 40-33-1B
Account No. 5080
ALL of that certain piece or parcel of land, with all improvements thereon, all rights, ways, easements, privileges and appurtenances thereunto belonging or in any way appertaining, situated in Pinetop Magisterial District, Middlesex County, Virginia, near Deltaville, lying on the eastern side of State Route #631, but not fronting thereon, and containing 1.4825 acres, more or less, but sold in gross and not by the acre. For a more accurate and particular description as to the metes and bounds of the property hereby conveyed, reference is made to a plat of survey prepared by John T. Ward, C.L.S., dated June 1979, revised July 13, 1979, a copy of which is of record in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, in Deed Book 123 at Page 232 and whereon said plat the property hereby conveyed is shown and designated as 1.4825 acres, Survey of Property for W.R. Jessie, Jr. Said property is bounded on the North by land now or formerly of S.C. Jackson; on the East and South by land now or formerly of Oscar F. Jackson; and, on the West by land formerly of Dorothy and R.E. Jessie, now the land of the Grantors herein, all as shown on the hereinabove mentioned plat of survey.
TOGETHER with an easement of right-of-way for reasonable ingress and egress to and from the property hereby conveyed out to State Route #631 over and along a right-of-way 16 feet in width running in an East-to-West direction out to the aforesaid State Route #631, all as shown on the hereinabove mentioned plat of survey.
And being the same real property conveyed to William Ryland Jessie, Jr. and Elizabeth Anne Dunlow Jessie, husband and wife, from Edward T. Williams and Dorothy J. Williams, husband and wife, by Deed dated July 19, 1979 and recorded among the records of the Clerk’s Office of the Circuit Court of Middlesex County, Virginia in Deed Book 123 at Page 230.
This description is made subject to all easements, conditions, agreements, restrictions and reservations of record which affect the property herein conveyed.
IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: William Ryland Jessie, Jr. aka Ryland Jessie aka W. Ryland Jessie, Jr. aka W.R. Jessie, whose last known address is 12519 General Puller Highway, Hartfield, Virginia 23071; Carol J. Collier aka Carol C. Jessie, whose last known address is 13634 Tidewater Trail, Saluda, Virginia 23149; and that any officers, heirs, devisees and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before October 16, 2013 in the Clerk’s Office of the Circuit Court of County of Middlesex, Virginia, and do what may be necessary to protect their interests in this cause.
