In execution of a Credit Line Deed of Trust (“Deed of Trust”) from Anthony M. Colletti and Christina K. Colletti, the Grantors, to Steven C. Layden, Trustee, which Deed of Trust is dated April 25, 2008, and recorded April 28, 2008, in the Clerk’s Office of the Circuit Court for the County of Middlesex, Virginia (“Clerk’s Office”), as Instrument No. 080001109, default having occurred in the payment of the debt secured by the Deed of Trust, William A. ALL that certain lot, piece or parcel of land with all improvements thereon and appurtenances thereto, lying and being in the Jamaica District of Middlesex County, Virginia, shown and designated as Lot 1, Section A, The Nesting as shown on Subdivision Plat made by Foster & Miller, P.C., dated January 12, 2007, entitled “The Nesting, Section A, Jamaica District, Middlesex County, Virginia”, a copy of which is recorded in Plat Cabinet 2, Pages 6-9, and reference to which is hereby made for a more particular description.
TOGETHER with a 30’ non-exclusive easement for ingress and egress to and from Punchbowl Lane as shown on aforementioned survey.
BEING the same real estate conveyed to Anthony Michael Colletti and Christina K. Colletti, husband and wife, as tenants by the entirety with the right of survivorship as at common law, by Deed of Gift from Lacey Colletti, Inc., a Virginia corporation, dated April 25, 2008 and recorded April 28, 2008 in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia as Instrument No. 080001108.
Terms: A deposit in the form of cash or certified funds in the amount of ten percent (10% ) of the successful bid will be required at the time of sale. Closing within ten (10) days of sale. Time is of the essence. The Property is being sold “AS IS” without representation or warranty of any sort or nature concerning its condition and subject to all rights, reservations, leases, covenants, conditions, easements, agreements, and restrictions superior to the Deed of Trust as they may lawfully affect the Property. No representation concerning status of title, liens, leases, occupancy, zoning, physical or environmental conditions, access, and/or availability of utilities are made by the undersigned or the beneficiary. Obtaining possession of the Property shall not be the responsibility of the Substitute Trustee or the holder of the note secured by the Deed of Trust, but shall be at the sole cost, risk, and expense of the successful bidder. The successful bidder shall pay for all recording charges, examination of title, settlement fees, and all costs of conveyancing, which shall be by Special Warranty Deed. The Substitute Trustee reserves the right to reject any bid(s), withdraw the Property from the sale at any time before the termination of the bidding, keep the bidding open for any length of time, postpone or adjourn the sale, reject any and all bids, review the qualifications of all bidders, and amend and/or supplement the terms of sale by verbal announcements prior to and/or during the sale. The holder of the note evidencing the debt secured by the deed of trust expressly reserves the right to bid at the sale.
In the event of resale due to the default of the successful bidder, the deposit shall be forfeited by the defaulting successful bidder and applied to the costs and expenses of the sale, and the balance, if any, shall be retained by the substitute trustee as compensation for the sale.

Notice is hereby given that Gaylon Layfield has applied for a permit from the Marine Resources Commission to construct 3 near-shore quarry stone sills, totaling 185 linear feet, spaced 25 feet apart, and approximately 20 feet channelward of a failing timber bulkhead (to be removed). The area behind the sills will be nourished with clean sand fill and planted with appropriate wetland vegetation adjacent to property on Fishing Bay near 919 Stove Point Road in Middlesex County.
