In execution of a Deed of Trust dated November 3, 2004, from Mt. Holly, LLC, recorded in the Clerk’s Office of the Circuit Court of Westmoreland County, Virginia in Deed Book 659, at Page 422, granting and conveying property therein described in trust to Elizabeth B. Hurd and Charles W. Paul, Trustees, the undersigned Trustee will offer for sale at public auction on February 26, 2010, at 12:00 noon, at the front entrance of the Westmoreland County Circuit Court Building, 15803 Kings Highway, Montross, VA 22520, the real estate lying in Westmoreland County, Virginia and more particularly described as follows:
Parcel 1: All that certain lot or parcel of land together with all improvements thereon and appurtenances thereto appertaining, lying in Cople Magisterial District, Westmoreland County, Virginia, containing 1.1 acres, more or less, described as Parcel “A” on a plat of Survey prepared by Lloyd W. English, Land Surveyor, dated September 1, 1983, entitled “Plat of Survey Showing A Portion of Property Owned by Robert N. Reamy” and recorded in Deed Book 307, Pages 373-375, of the Clerk’s Office of the Circuit Court of Westmoreland County, Virginia, and to which reference is hereby made for a more accurate description of the real estate.
Parcel 2: All that certain lot or parcel of land together with all improvements thereon and appurtenances thereto appertaining, lying in Cople Magisterial District, Westmoreland County, Virginia, containing 0.3154 acre, more or less, described as Parcel A-1 on a plat of Survey prepared by Richard B. Allison, Jr., C.L.S., dated October 22, 1984, entitled “Plat Showing A Portion of Property Belonging to Robert N. Reamy, Jr.” and recorded in Deed Book 316, Page 390, of the aforesaid Clerk’s Office, and to which reference is hereby made for a more accurate description of the real estate.
Together with a right of access in common with others along a 50 foot right of way leading from State Route 202 to the property now or formerly belonging to Robert N. Reamy, Jr. (such land of Reamy lying north of Parcels 1 and 2), and abutting the eastern boundaries of Parcels 1 and 2. Reference is made to the deed recorded in Deed Book 307, Page 371, wherein such easement is described.
Together with a perpetual easement for the installation, operation and maintenance of underground sewer lines and an on-site underground sewerage disposal system, including distribution tank and drainfield lines, as shown on a plat of survey made by Richard B. Allison, Jr., Land Surveyor, recorded in the aforesaid Clerk’s Office in Deed Book 497, pages 771 and 772.
The property shall be sold “AS IS” and the sale is subject to all restrictions, rights of way, conditions, easements, judgments, any and all liens, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust, and to the real estate taxes from the date of the sale.
TERMS OF SALE: All cash. A deposit of $40,000.00 by bank cashier’s check payable to the Trustee may be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the trustee’s compensation authorized by the deed of trust and the law in such cases.
Conveyance of the property shall be by trustee’s Special Warranty Deed. Except for the statutory grantor’s tax paid by the trustee, all costs of conveyance, including, but not limited to, examination of title, recording fees, and settlement fees, shall be at the cost of the purchaser.
The trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.
