NOTICE OF TRUSTEES’ SALE

In execution of a Deed of Trust dated February 29, 2012, in the original amount of $750,000.00, recorded as Instrument Number 120000434 in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, the undersigned Substitute Trustees, any of whom may act, will on July 25, 2013, at 10:00 a.m., at 527 General Puller Highway, Saluda, Virginia 23149, offer for sale at public auction to the highest bidder the following property with improvements thereon:
ALL that certain piece or parcel of land, with all improvements thereon, situated in Saluda Magisterial District, Middlesex County, Virginia, in the Village of Saluda, fronting on the eastern side of Business Route #17, and containing 2.698 acres. For a more accurate and particular description as to the metes and bounds of the property hereby conveyed, reference is made to a plat of survey prepared by Dalton O. Brownley, Jr., Land Surveyor, dated September 21, 2005, entitled “Physical Survey of 2.698 Acres,” a copy of which is attached to and recorded with that certain Deed recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia (the “Clerk’s office”) in Deed Book 423, Page 123, and by referenced thereto incorporated herein.

The property will be open for inspection on July 25, 2013, from 9:00 a.m. to 10:00 a.m.
This sale is subject to the restrictions, rights of way, conditions, easements, and mechanic’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust.
Deposit of $35,000.00 by cashier’s check shall be required to qualify as a bidder prior to the sale, except from the Noteholder.
The deposit, without interest, is applied to the purchase price at settlement. The successful bidder also shall be required to pay to Motley Auction’s & Real Estate Group a buyer’s premium in the amount of ten percent (10%) of the successful bid. Settlement will be held on or before thirty (30) days after sale; time being of the essence. Upon purchaser’s default, the deposit shall be forfeited and the property shall be resold at the risk and costs of the defaulting purchaser.
The balance of the purchase price shall be in cash or its equivalent. Settlement shall be at the offices of the Substitute Trustees or other mutually agreed location. The property and any improvements thereon shall be sold in “as is” condition without any warranties. The successful bidder shall assume all loss or damage to the property from and after the time of the sale. Purchaser shall be responsible for all costs of the conveyance, which shall be by special warranty including, but not limited to, the preparation of the deed and the grantor’s tax. In addition, at settlement, the successful bidder shall pay all past due and current assessments, sewer or water charges, and real estate taxes, and any penalties and interest due on any of the foregoing, with respect to the Property prorated to the date of the foreclosure sale, and the purchaser also shall be responsible for all such charges from and after the sale date. The sale is subject to such additional terms as the Substitute Trustees may announce at the time of sale. The purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale.

TERMS OF SALE: Neither the Substitute Trustee nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder. If payment of the balance does not occur within fifteen days of the sale date, the deposit will be forfeited.  Seller shall not be responsible for any costs incurred by the purchaser in connection with their purchase or settlement, including, without limitation, state and local recording fees, title insurance or research, or any other costs of purchaser’s acquisition. Trustee shall have no duty to obtain possession for purchaser.  All risks of casualty pass to successful bidder at conclusion of bidding.  The property and the improvements thereon will be sold “AS IS” and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property. Sale is subject to post-sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower(s) entered into any repayment agreement, reinstated or paid off the loan prior to the sale.  In any such event, the sale shall be null and void, and the Purchaser’s sole remedy, in law or equity, shall be the return of the Purchaser’s deposit without interest. And it is further ORDERED that this Order be published once a week for four successive weeks in the Southside Sentinel, 276 Virginia Street, P.O.
