In execution of a Deed of Trust in the name of Hunton Creek, LLC dated November 30, 2005, recorded in Deed Book 426 at page 319 in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, which Noteholder is Virginia Commonwealth Bank, f/k/a First Federal Savings Bank of Virginia, the undersigned Substitute Trustees, either of whom may act, will offer for sale at public auction to the highest bidder, at the front entrance of the Middlesex County Circuit Court, Routes 17 & 33, Courthouse, Saluda, Virginia on January 27, 2010, at 10:00 a.m., the following property:
All that certain lot or parcel of land, lying and being situate in Pinetop District, Middlesex County, Virginia near North End Wharf containing 30.00 acres, more or less, as shown on a plat of survey made by Brownley Land Surveying dated August 13, 2004, entitled “Boundary Survey of 30.00 Acres Located in the Pinetop District of Middlesex County Virginia”, a copy of which is recorded in the Middlesex County Circuit Court Clerk’s Office.
In addition, sale shall be made subject to all existing easements and restrictive covenants as the same may lawfully affect the real estate. Property to be sold in “AS IS” condition without any warranties. Property shall be conveyed to the purchaser by special warranty deed.
Terms of Sale: Cash, Cashier’s or Certified Check at sale made payable to Hill and Rainey Attorneys. Certified funds must be presented to Trustee for inspection at the start of sale in order to be qualified to bid. Bidding Increments: Not less than $100.00. A non-refundable deposit of $75,000.00 or ten percent (10%) of the purchase price, whichever is lower, will be required from the successful bidder at the time of sale with settlement within fifteen (15) days from the date of sale.
