In execution of a Credit Line Deed of Trust (“Deed of Trust”) from Anthony M. Colletti and Christina K. Colletti, the Grantors, to Steven C. Time is of the essence. The Property is being sold “AS IS” without representation or warranty of any sort or nature concerning its condition and subject to all rights, reservations, leases, covenants, conditions, easements, agreements, and restrictions superior to the Deed of Trust as they may lawfully affect the Property. No representation concerning status of title, liens, leases, occupancy, zoning, physical or environmental conditions, access, and/or availability of utilities are made by the undersigned or the beneficiary. Obtaining possession of the Property shall not be the responsibility of the Substitute Trustee or the holder of the note secured by the Deed of Trust, but shall be at the sole cost, risk, and expense of the successful bidder. The successful bidder shall pay for all recording charges, examination of title, settlement fees, and all costs of conveyancing, which shall be by Special Warranty Deed. The Substitute Trustee reserves the right to reject any bid(s), withdraw the Property from the sale at any time before the termination of the bidding, keep the bidding open for any length of time, postpone or adjourn the sale, reject any and all bids, review the qualifications of all bidders, and amend and/or supplement the terms of sale by verbal announcements prior to and/or during the sale. The holder of the note evidencing the debt secured by the deed of trust expressly reserves the right to bid at the sale.
In the event of resale due to the default of the successful bidder, the deposit shall be forfeited by the defaulting successful bidder and applied to the costs and expenses of the sale, and the balance, if any, shall be retained by the substitute trustee as compensation for the sale.
