In execution of a certain deed of trust from D M Ingram, Inc., dated February 29, 2008, in the original principal amount of $190,000.00; recorded in the Clerk’s Office, Circuit Court of Middlesex County, Virginia, as Document #08-489 default having been made in the payment of the debt therein secured and at the request of the noteholder, the undersigned Substitute Trustees, either of whom may act, after giving thirty days due notice to the owners of the real estate of the date, time, place and terms of sale, will offer for sale at public auction in front of the building housing the Circuit Court of the County of Middlesex, Virginia, located at 73 Bowden Street, Saluda, Virginia 23149, on April 13, 2011 at 11:00 a.m., the real estate with improvements thereon located in Pinetop Magisterial District, Middlesex County, Virginia, more particularly described as:
All of that certain tract or parcel of land, together with all improvements thereon, situated in Pinetop Magisterial District, Middlesex County, Virginia containing 5.000 acres, more or less, and being more particularly shown and described as “5.000 ACRES” on that certain plat of survey prepared by Dalton D. Brownley, Jr., L.S., dated August 17, 2006, a copy of which is recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia in Plat Cabinet 2, Slide 11-11.
Sale shall be made subject to all existing prior liens, easements and restrictive covenants as the same may lawfully affect the real estate.
This sale shall be subject to the right of redemption granted to the Secretary of the Treasury under 26 U.S.C. Section 7425 (d) and subject to all restrictions, rights of way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust.
Terms of Sale: Cash. Settlement within 30 days of sale.
A bidder’s deposit of 10% of the sale price will be required.
The balance of the purchase price shall be in cash or its equivalent. Settlement shall be at the office of the Substitute Trustees or other mutually agreed location. The property and any improvements hereon shall be sold in “as is” condition without any warranties. The successful bidder shall assume all loss or damage to the property from and after the time of the sale.
Purchaser shall be responsible for all costs of the conveyance, which shall be by special warranty. The sale is subject to such additional terms as the Substitute Trustees may announce at the time of sale. Purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale.

In execution of a Deed of Trust dated October 3, 2001, in the original principal amount of $650,000.00, recorded in Deed Book 328 at page 668, re-recorded in Deed Book 332 at page 700, and amended in Deed Book 363, at page 802, in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, defaults having occurred under said Deed of Trust and in the payment of the debts secured thereby and being instructed to do so by the holder of the Note, the Substitute Trustees, either of whom may act, will on April 12, 2011, at 12:00 p.m., at the main entrance to the courthouse of Middlesex County, Virginia, at the intersection of Routes 17 & 33, Saluda, VA 23149, offer for sale at public auction to the highest bidder the following property with improvements thereon:

ALL that certain piece or parcel of land, together with all improvements, rights, ways and appurtenances thereunto belonging, lying near Saluda on the right of U.S. Route #17 as same leads from Saluda to Warner, situated in Saluda Magisterial District, Middlesex County, Virginia, containing 3.893 acres and shown as Lot 1 on a plat of survey prepared by Stanley E. Payne, III, dated August 26, 1999, a copy being recorded in the aforesaid Clerk’s Office in Plat Book 14, page 351, to which reference is hereby made.
This sale is further subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust. Deposit of ten percent of the sales price by certified or cashiers check (not cash) shall be required to qualify as a bidder before the sale, except from the Noteholder. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after sale. Time is of the essence. In the event of default the deposit shall be forfeited and the property shall be resold at the risk and costs of the defaulting purchaser. In the event the Substitute Trustees do not execute a deed of conveyance for any reason, the purchaser’s sole remedy shall be the refund of the deposit. The balance of the purchase price shall be in cash or its equivalent. Settlement shall be at the offices of the Substitute Trustees or other mutually agreed location. The property and any improvements thereon shall be sold in “as is” condition without any warranties.
