In execution of a deed of trust in the original principal amount of $35,000.00 with interest thereon, dated December 15, 1999, recorded in the Clerk’s Office, Circuit Court, Middlesex County, Virginia, in DB 302 at PG 466, the undersigned Substitute Trustee appointed as such by instrument dated May 22, 2012, and recorded in said Clerk’s Office as Instrument No. 121123, after default having occurred thereunder, and on the Note Secured thereby, and after having been requested to do so by the Noteholder, will offer for sale at public auction the property described in said deed of trust with improvements thereon, and described as follows:
All that certain parcel of land containing two (2) acres, more or less, situated in Pinetop Magisterial District, Middlesex County, Virginia, and bounded now or formerly on the North by the land of Nancy B. Harris; East by a private right-of-way leading from State Routes Numbers 3 and 33; South by a private forty foot right-of-way; and West by land now or formerly of Gregory S. Luckett and Tina M. Luckett.
Sale is to be held at the entrance to the building which houses the Circuit Court of Middlesex County located at 73 Bowden Street, Saluda, Va. 23149
on July 25, 2012
at 12:00 p.m.
Sale is subject to all restrictions, easements, liens, agreements and other matters of record affecting the property which are superior to the aforesaid deed of trust, if any, the property is sold “as is,” and the property will be conveyed by Special Warranty Deed.
TERMS: Cash with settlement within fifteen days of the sale date with time being of the essence. Additional terms will be announced at the time of the sale.
Deposit of Ten Percent (10%) of the successful bid will be required from the successful bidder by way of CASH, CERTIFIED OR CASHIER’S CHECK at the time and place of sale.

ORDER OF PUBLICATION
The object of this Suit is to effect partition among the owners by sale or otherwise of a certain piece or parcel of land, together with all improvements thereon, designated among the land records of Middlesex County, Virginia as Tax Map 7-78C, situated in Jamaica Magisterial District, Middlesex County, Virginia, initially containing 12 acres, more or less, but now containing 11.43 acres, more or less, fronting on VSH # 605. The twelve (12) acres, more or less, which is the subject of this litigation was initially acquired by George Key, a/k/a George Henry Key, by Deed dated January 29, 1870 from Katy Keys, et al recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia (hereinafter “Clerk’s Office”) in Deed Book 24, at Page 78. By Deed dated March 7, 1961 and recorded in the Clerk’s Office in Deed Book 80, at Page 250, some of the purported heirs of George Key a/k/a George Henry Key, conveyed their interest in the twelve (12) acres, more or less, to William L. Shelley. William L. Shelley died testate on October 12, 1968 and under the terms of his Last Will and Testament, recorded in Will Book 29, at Page 30, he devised his interest in the twelve (12) acres, more or less, to Doris Virginia Shelley for life (who died September 27, 1997) with the remainder to William Lewis Shelley, Jr., the Plaintiff in this litigation. By Deed dated March 1, 1983 recorded in the Clerk’s Office in Deed Book 139, at Page 250, William Lewis Shelley, Jr. and Nancy M. Shelley, husband and wife, conveyed 0.57 of an acre of the initial twelve (12) acres tract to the Commonwealth of Virginia, leaving 11.43 acres, more or less, which is the subject of this litigation.
An Affidavit having been made and filed that Ada Bibbs, Anna Jones, Helen Williams, Alberta Jones, William Key, Gladys Jacobs, Warren Key, Theodore Key, Reginald Key, Lorraine Key and Carl Key may not be residents of the State of Virginia and the Complaint stating that there are or may be persons interested in the subject property whose names are unknown and making them Respondents by the general description of Parties Unknown, and an affidavit having been made and filed that their names are unknown and their last known addresses are unknown, such unknown parties being the heirs, devisees, or successors in title of George Key, a/k/a George Henry Key, Louinia Key Robinson, a/k/a Lavinia Robinson, William Key and Walter Key.
It is ORDERED that said non-resident Respondents namely; Ada Bibbs, Anna Jones, Helen Williams, Alberta Jones, William Key, Gladys Jacobs, Warren Key, Theodore Key, Reginald Key, Lorraine Key and Carl Key and the said persons made Respondents by the general description of Parties Unknown do appear before the Circuit Court of Middlesex County, Virginia, on August 1, 2012, at 9:30 a.m. to identify themselves, and to do what is necessary to protect their interests.
It is further ORDERED that the forging be published once a week for four (4) successive weeks in the Southside Sentinel, a newspaper having general circulation in Middlesex County, Virginia.
