In execution of that certain deed of trust in the original principal amount of $195,000.00 dated September 17, 2007 and recorded among the land records of Middlesex County, Virginia, as Instrument Number 070002606, as amended by an instrument appointing the undersigned as Substituted Trustee, default having been made in the payment of the indebtedness thereby secured and having been requested to do so by the holder of the note evidencing the said indebtedness, the undersigned Substituted Trustee will offer for sale at public auction in front of the Middlesex Circuit Court, Routes 17 and 33, Saluda, Virginia on:

The property described in said deed of trust located at the above street address, and more particularly described as:
All that certain lot, piece or parcel of land, together with all improvements thereon, situated in Pinetop Magisterial District, Middlesex County, Virginia, near Deltaville, containing one half of an acre, more or less, and commencing at the angle formed by the right of way leading from the home J.R. Callis with the public road to Timber Neck and extending along said road a distance of 35 yards; thence at right angles with said road a distance of 70 yards; thence at right angles a distance of 35 yards; thence at right angles a distance of 70 yards to the place of beginning. Said last mentioned 35 yard line is to run parallel with the said public road.
TERMS OF SALE: Cash or certified funds. A non-refundable deposit of ten percent (10%) of the bid price, payable in cash or by certified or cashier’s check to the undersigned will be required of the successful bidder at time of sale. Terms of sale to be complied with within 14 days from date of sale or deposit will be forfeited and property will be resold at costs of defaulting purchaser. All real estate taxes to be adjusted as of date of sale. Seller shall not be responsible for any costs incurred by the purchaser in connection with their purchase or settlement, including, without limitation, state and local recording fees, title insurance or research, or any other costs of purchaser’s acquisition. The property and the improvements thereon will be sold as is, without representations or warranties of any kind. The sale is subject to all other liens, encumbrances, conditions, easements and restrictions, if any, superior to the aforesaid deed of trust and lawfully affecting the property. Trustee shall have no duty to obtain possession for purchaser. All risks of casualty pass to successful bidder at conclusion of bidding. Additional terms may be announced at the sale.

A public hearing will convene at 9:30 a.m. on Tuesday, August 24, 2010, at the office of the Virginia Marine Resources Commission (VMRC), 2600 Washington Avenue, 4th floor, Newport News, to review an application submitted by James Covington seeking authorization from VMRC to remove four (4) deteriorated groins and construct four (4) replacement vinyl groins adjacent to his property situated along Fishing Bay at 443 Stove Point Road in Middlesex County. The project will require a Coastal Primary Sand Dune/Beach permit and a subaqueous permit.

A public hearing will convene at 9:30 a.m. on Tuesday, August 24, 2010, at the office of the Virginia Marine Resources Commission (VMRC), 2600 Washington Avenue, 4th floor, Newport News, to review an application submitted by Mr. Steve Johnson seeking authorization from VMRC to remove a deteriorated groin and construct a replacement vinyl groin and to construct 50 linear feet of vinyl bulkhead aligned two (2) feet channelward of a deteriorated timber bulkhead adjacent to his property situated along the Rappahannock River at 752 Felton Road in Middlesex County. The project will require a Coastal Primary Sand Dune/Beach permit and a subaqueous permit.

PUBLIC NOTICE
A public hearing will convene at 9:30 a.m. on Tuesday, August 24, 2010, at the office of the Virginia Marine Resources Commission (VMRC), 2600 Washington Avenue, 4th floor, Newport News, to review an application submitted by Sara Carneal seeking authorization from VMRC to construct a 12-foot wide by 85-foot long nearshore riprap breakwater sill with 156 cubic yards of sandy material placed landward of the sill as beach nourishment and to support the planting of wetland vegetation and to construct a 50-foot long vinyl groin adjacent to her property situated along the Piankatank River at 975 Wilton Creek Road in Middlesex County. The project will require a Coastal Primary Sand Dune/Beach permit and a subaqueous permit.
