In execution of a Deed of Trust dated May 12, 2006, from J&B Properties, LLC, recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia as Instrument Number 060001275, granting and conveying property therein described in trust to Elizabeth B. Hurd and William E. Allaun, III, Trustees, the undersigned Trustee will offer for sale at public auction on March 31, 2010, at 12:45 p.m., at the front entrance of the new Middlesex County Courthouse, 73 Bowden Street, Saluda, VA 23149, the real estate lying in Middlesex County, Virginia and more particularly described as follows:
All that certain piece or parcel of land, together with all improvements thereon, situated in the Town of Urbanna, Middlesex County, Virginia, fronting on Virginia Street (State Route T-1002), and containing 0.2956 of an acre. For a more accurate and particular description as to the metes and bounds of the property, reference is made to a plat of survey prepared by Norman L. Sutton, Land Surveyor, of Sutton & James, P.C., dated February 18, 2002, entitled “Boundary & Location Survey of Land to be Acquired By James E. Vautrot & Bonnie J. Vautrot,” a copy of which is recorded in the Clerk’s Office, Circuit Court, Middlesex County, Virginia, in Plat Book 15, page 338, whereon said plat the property is shown and designated as “0.2956 ACRE.”
TOGETHER WITH a perpetual, nonexclusive easement, which shall run with the property, for drainage, utility, ingress and egress a total of sixteen (16) feet in width, ten (10) feet of which runs along and within the entire southern boundary line of the property, and six (6) feet of which runs along the entire northern boundary of the property shown on the above referenced Sutton & James plat as “Now or formerly Elizabeth A. Leaf,” and established by a Deed of Easement, dated April 2, 1990, recorded in the aforesaid Clerk’s Office in Deed Book 189, at page 702.
The property shall be sold “AS IS” and the sale is subject to all restrictions, rights of way, conditions, easements, judgments, any and all liens, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust, and to the real estate taxes from the date of the sale.
TERMS OF SALE: All cash. A deposit of $15,000.00 by bank cashier’s check payable to the Trustee may be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the trustee’s compensation authorized by the deed of trust and the law in such cases.
Conveyance of the property shall be by trustee’s Special Warranty Deed. Except for the statutory grantor’s tax paid by the trustee, all costs of conveyance, including, but not limited to, examination of title, recording fees, and settlement fees, shall be at the cost of the purchaser.
The trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.

PUBLIC NOTICE
Environmental Permit Application
PURPOSE OF NOTICE: To announce a public meeting and seek public comment on a permit application to allow the land application of biosolids in Middlesex County, Virginia.
PUBLIC MEETING: Middlesex County’s Cooks Corner Office Complex, 2893 General Puller Highway, Saluda, VA 23149 on Wednesday, March 31, 2010 at 6:30 PM.
PURPOSE OF PUBLIC MEETING: For the Department of Environmental Quality (DEQ) to discuss technical issues related to the permit application submitted by Recyc Systems, Inc. of Remington, VA, to apply treated biosolids in Middlesex County, VA. “Biosolids” is a term that refers to solid, semisolid, or liquid materials removed from municipal sewage and treated to be suitable for recycling as fertilizer.
PUBLIC COMMENT PERIOD: March 31, 2010 through April 30, 2010.
PROPOSED PERMIT NAME: Virginia Pollution Abatement Permit for Recyc Systems, Inc. issued by DEQ, under the authority of the State Water Control Board.
PROJECT DESCRIPTION: Recyc Systems, Inc. has applied for a permit to authorize the land application of biosolids to 134 fields in Middlesex County, VA, totaling approximately 3398.4 acres of agricultural land. The owners of the fields and number of fields are listed as follows: Rowland R. Adamson, 2 fields; O.B. Taliaferro, et alia, 4 fields; D.W. Burch, 6 fields; Robert B. Croxton, Jr., 2 fields; Allen D. Freeman, 1 field; John W. Dickerson, 1 field; SLM, LLC, 3 fields; Piedmont Farms, 7 fields; Jeanette C. Calhoun, 4 fields; Louise E. Harrell, 37 fields; Farm 606 North LLC, 4 fields; Daniel V. Fary, Trustee, 2 fields; Malvin H. Lee, 2 fields; Albert H. Marshall, et alia, 8 fields; Randolph Bagby, Jr., 1 field; Katherine S. The biosolids will be land applied as a fertilizer at a controlled rate in accordance with a nutrient management plan that will be developed for each site. The applicant proposes to utilize biosolids on farmland without a discharge to surface waters.
HOW TO COMMENT: DEQ accepts written comments by e-mail, fax or postal mail. All comments must be in writing and must be received by DEQ during the comment period of March 31, 2010 through April 30, 2010. Written comments must include: 1) The names, mailing addresses and telephone numbers of the person commenting and of all people represented by the citizen; and 2) A brief, informal statement on how the proposal affects the person commenting. DEQ will also accept written and oral comments at the public meeting. The public may review the permit application at the public meeting and at the DEQ office named below.
