vs. CL 11-66
Carter Morris, Janette Morris,
Phoebe Robinson, Sarah E. Freeman, Amanda Kidd
If living, and if not then their devisees, heirs-at-law, if any as Parties Unknown
The object of this suit is to declare a cemetery located on property owned by Leo R. South and Catherine South at 1268 Old Virginia Street, Urbanna, Virginia to be abandoned and to remove and reinter the remains of one unknown person in a proper cemetery. The cemetery was created by a court order in 1906 in the partition of twenty-two acres, in which each named defendant was allotted one lot. Lot 5 was allotted to Carter Morris, subject to a family graveyard to be located in the northwest corner of Lot 5 along the public road, for the benefit of Carter Morris and the other defendants herein. One person was subsequently buried in the cemetery, probably in the 1940’s or 1950’s, but whose identity is unknown. No burials have occurred in the cemetery in more than fifty years. The interests of the defendants appear to remain outstanding. It is unknown whether any are alive, or who their devisees, heirs at law, or other successors in interest might be.
An Affidavit has been made and signed that Carter Morris, Janette Morris, Phoebe Robinson, Sarah Freeman, and Amanda Kidd may or may not be alive, that their whereabouts are unknown, that their heirs-at-law or devisees, if any, are unknown, and that their may be other parties unknown, parties under a disability, or parties who may be incompetent, after diligent inquiry was made to ascertain such information.
IT IS ORDERED that Carter Morris, Janette Morris, Phoebe Robinson, Sarah Freeman, and Amanda Kidd, or any heir-at-law or devisee claiming under any of them, Parties Unknown, Parties Under A Disability, or Parties Incompetent,if any, their heirs, or successors in title, if any, appear before the Circuit Court of Middlesex County, Virginia, 73 Bowden Street, Saluda, Virginia, on 17 August 2011 at 9:30 AM, to identify themselves, and do what is necessary to protect their interests.
IT IS ORDERED that this Order be published once each week for four successive weeks in the Southside Sentinel, Urbanna, Virginia, beginning on 14 July 2011.
Entered: July 6, 2011.
