In execution of a deed of trust dated August 21, 2007, and recorded in the Clerk’s Office, Circuit Court, County of Middlesex, Virginia, as Instrument No. 070002145, default having occurred in the payment of the debt secured thereby, and being requested to do so by the holder of the note secured thereby, the undersigned substitute trustee (“Trustee”) will offer for sale at public auction at the front entrance of the Courthouse of the Circuit Court of Middlesex County, Virginia, 73 Bowden Street, Saluda, Virginia, on Friday, July 23, 2010, at 11:30a.m. the unimproved real property briefly described as 7.6± acres off Waterview Road (State Route 640), located in Water View, Virginia, in Middlesex County, as more particularly described in such deed of trust to which reference is hereby made for a more complete description. The driveway onto the property to be sold is the second to last driveway on the right side of Waterview Road (headed towards the Rappahannock River), and such driveway also serves Tax Map No.9-55 (which contiguous parcel is shown on Middlesex County’s online records as having a street address of 5242 Waterview Road). The property to be sold has approximately 150 feet of frontage on the Rappahannock River. TERMS OF SALE: CASH. A deposit of $25,000 by certified check will be required prior to bidding. Settlement within 30 days of sale. Procedures and terms of sale shall be subject to Trustee’s discretion, shall be announced prior to sale, and shall control. Sale subject to all matters of title prior or superior to lien of deed of trust. Foreclosure sale agreement form with all terms of sale is available from Trustee upon request. Title commitment and copy of survey (both without representations or warranties) are also available for review.

PUBLIC NOTICE
Notice is hereby given that William Alderman Jr., has applied for a permit from the Marine Resources Commission to construct two (2) 15.5-foot wide by 65-foot long riprap breakwaters and place approximately 300 cubic yards of sand landward of the breakwaters as beach nourishment adjacent to his property situated along LaGrange Creek and the Rappahannock River at Lot 6 Shell Reef Court in Middlesex County.
