In this proceeding, Alfa Specialty Insurance Corporation (“Alfa”), seeks a declaration that it has no obligation to defend or indemnify Alberto Bojorquez Santos (“Santos”) for any claims presented against him arising out of an automobile accident that occurred on June 22, 2011, between Alberto Santos and Andrew R. Bernstein (“Bernstein”), on Powhite Parkway near Forest Hill Avenue. Bernstein has filed a lawsuit against Santos alleging that Santos’ negligence resulted in injuries to Bernstein.
It appearing by affidavit filed according to law that the defendant, Alberto Bojorquez Santos, cannot be found and that diligence has been used by and on behalf of Alfa to ascertain the location of Santos without effect:
Finding it proper to do so, it is ORDERED that Alberto Bojorquez Santos appear within 10 days after due publication of this Order, in the Clerk’s Office of this Court, and do what may be necessary to protect his interests in this cause, and it is further ORDERED that if Santos desires to assert any objection or defense to the decree that Alfa owes him no duty to defend or indemnify him for any claims arising out of the accident mentioned above or to the jurisdiction of the Court to hear the case he shall file his answer and grounds of defense specifying the grounds of any objection or defense to the absence of insurance coverage available to him or to the jurisdiction of the Court to hear the case.

ORDER OF PUBLICATION
The object of this Suit is to effect partition among the owners by sale of the property briefly described as follows:
PARCEL A
ALL that certain parcel of land briefly described as 171.638 acres +/-, lying and being in Middlesex County, Virginia and more accurately described on the survey of Tomlin & Keyser, Land Surveyors, dated April 19, 2012, said plat is attached to this Complaint as Exhibit “A”.
PARCEL B
ALL that certain parcel of land briefly described as 34.00 acres +/-, lying and being in Middlesex County, Virginia and more accurately described on the survey of Tomlin & Keyser, Land Surveyors, dated April 19, 2012, said plat is attached to this Complaint as Exhibit “A”.
The property which is the subject of this suit is the property obtained by James W. Taylor and Dolly W. Taylor by several deeds, copies of which are recorded in the Clerk’s Office of the Circuit Court of Middlesex County, VA.
James W. Taylor, by his Last Will and Testament left a one-half undivided interest in the Revis Farm property to his daughter, Barbara Taylor Lowrance and her children, Terry Lowrance, David Lowrance and Steven Lowrance and a one-half undivided interest to the heirs at law of his wife, Dolly W. Taylor.
Dolly W. Taylor, by her Last Will and Testament directed that the 205.638 acres which is the subject of this suit, be offered for sale to Bill Taliaferro, Bryant Taliaferro and David Taliaferro, if they should desire to purchase the property from the estate at the appraised value, and said proceeds from sale are to be distributed, one-half to her surviving nieces and nephews, per capita and one-half to her stepdaughter, Barbara G. Lowrance and Barbara G. Lowrance’s children, per capita.
The Complaint states that there are or may be persons interested in the subject property whose names are unknown and making them Defendants by the general description of Parties Unknown and their last known addresses are unknown, such unknown parties being the heirs, devisees, or successors in title of Dolly W. Taylor and James W. Taylor.
It is ORDERED that said persons made Defendants by the general description of Parties Unknown do appear before the Circuit Court of Middlesex County, Virginia on September 5, 2012, at 9:30 a.m., to identify themselves, and to do what is necessary to protect their interests.
It is further ORDERED that the foregoing be published once a week for four (4) successive weeks in the Southside Sentinel, a newspaper having general circulation in Middlesex County, Virginia.
