In execution of a Deed of Trust in the name of Marilyn Y. Mizelle dated August 26, 2005, recorded in Deed Book 421, page 29 in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, which Noteholder is Branch Banking and Trust Company, the undersigned Substitute Trustees, either of whom may act, will offer for sale at public auction to the highest bidder, at the front entrance of the Middlesex County Circuit Court, 73 Bowden Street, Saluda, Virginia on December 19, 2012, at 10:00 a.m., the following property:
All that certain lot or parcel of land situate in Saluda Magisterial District, Middlesex County, Virginia, shown and designated as Lot 1 - 3.947 acres, as shown on a certain plat dated September 20, 1995 and recorded in the Circuit Court Clerk’s Office of Middlesex County in Plat Book 12, page 307. In addition, sale shall be made subject to all existing easements and restrictive covenants as the same may lawfully affect the real estate. Property to be sold in “AS IS” condition without any warranties. Property shall be conveyed to the purchaser by special warranty deed.
Terms of Sale: Cash, Cashier’s or Certified Check at sale made payable to Hill and Rainey Attorneys. Certified funds must be presented to Trustee for inspection at the start of sale in order to be qualified to bid. Bidding Increments: Not less than $100.00. TERMS OF SALE: Neither the Substitute Trustee nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder. The purchaser at the sale will be required to pay all closing costs. Real estate taxes, water/sewer fees and other public charges will be prorated as of the date of sale. The risk of loss or damage to the property passes to the purchaser immediately upon the conclusion of the Substitute Trustee’s sale. Terms: CASH or certified funds. A bidder’s deposit of $4,986.50, whichever is lower, will be required at the time of sale with the balance of the sale price to be paid within 15 days at the office of the Substitute Trustee. Time is of the essence as to the closing date and the payment of the purchase price. If payment of the balance does not occur within fifteen days of the sale date, the deposit will be forfeited. Seller shall not be responsible for any costs incurred by the purchaser in connection with their purchase or settlement, including, without limitation, state and local recording fees, title insurance or research, or any other costs of purchaser’s acquisition. Trustee shall have no duty to obtain possession for purchaser. All risks of casualty pass to successful bidder at conclusion of bidding. The property and the improvements thereon will be sold “AS IS” and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property. Sale is subject to post-sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower(s) entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser’s sole remedy, in law or equity, shall be the return of the Purchaser’s deposit without interest. ORDER OF PUBLICATION
The object of this suit is to obtain a divorce from the bond of matrimony from the Defendant on the ground of having lived separate and apart for a period exceeding one year.
It appearing by affidavit that the Defendant is not a resident of this Commonwealth and the Defendant’s last known address is unknown, the Defendant’s present whereabouts are unknown, and diligence has been used by or on behalf of the Plaintiff to ascertain in what county or city the Defendant is without effect, it is ORDERED that the Defendant appear before this Court on or before January 2, 2013 and protect her interests herein.
And it is further ORDERED that the above paragraphs be published once a week for four successive weeks in the Southside Sentinel, a newspaper of general circulation in the County of Middlesex, Virginia. The Clerk of this Court shall post this Order at the front door of the courthouse, and shall mail a copy of this Order to the defendant at the post office address, if any, given in the affidavit of the plaintiff filed herein.
