In the event a successful bidder fails to consummate the purchase in accordance with the terms of sale as herein provided and in the contract of sale, the deposit will be applied to the costs and expenses of the sale and thereafter to the outstanding balance on the Note, and the Property may either be resold at the risk and expense of the defaulting successful bidder or Trustee may accept the next highest bid at the foreclosure sale, if available.
