DISTRICT, MIDDLESEX COUNTY, VIRGINIA
TAX MAP NO. 40-38-2
In execution of a Deed of Trust, dated December 7, 2007 recorded in the Clerk’s Office of the Circuit Court of Middlesex, Virginia as Instrument Number 070003011 granting and conveying property therein described in trust to Elizabeth B. Hurd and John B. Wallin, Trustees, the undersigned Trustee will offer for sale at public auction on July 1, 2011, at 12:00 noon, at the front entrance of the new Middlesex County Court Building, 73 Bowden Street, Saluda, VA 23149, the real estate lying in Middlesex County, Virginia and more particularly described as follows:
ALL that certain piece or parcel of land, with all improvements thereon, situated in Pinetop Magisterial District, Middlesex County, Virginia lying on the southern side of State Route #33, and containing 15,890 square feet. For a more accurate and particular description as to the metes and bounds of the property, reference is made to a plat of survey prepared by Edloe Morecock, III, L.S., dated January 23, 2002, entitled “Plat Showing Physical Survey of the Land to be Conveyed to James R. and Margee M. Wescott”, a copy of which plat is of record in the Clerk’s Office, Circuit Court, Middlesex County, Virginia, in Deed Book 335, Page 84, whereon said plat the property hereby conveyed is shown and designated as “15,890 Sq. Ft.”
TOGETHER WITH the right, privilege and easement which right, privilege and easement shall be appurtenant to the property in common with that property designated on the above mentioned Morecock plat as “N/F Kathleen A. Bueker D.B. 81 @ pg. 533”, and their successors in title, for the use, maintenance, improvement, or placement of a septic drainfield system and appurtenances thereonto, on and under that are of 0.6091 of an acre heretofore conveyed to Richard J. McDonagh and Judith H. McDonagh, husband and wife, and designated on the aforementioned Morecock plat as “Drainfield Easement, 1464 Sq. Ft.” as well as that area lying between the southern boundary of the property and the aforesaid designated drainage easement as depicted on the aforementioned Morecock plat as “229 Sq. Ft. Drainfield Easement for Wescott Parcel over Bueker Parcel (229 Sq. Ft.)”, necessary for the enjoyment thereof, including, but not limited to the laying of pipes, drains, pumps, ingress and egress necessary to permit the effectual use and repair of the foregoing appurtenance, as established in the above mentioned McDonagh deed recorded in the Clerk’s Office of the Circuit Court of Middlesex County, Virginia, in Deed Book 334, Page 447, their terms of which are incorporated by reference.
TOGETHER WITH AND SUBJECT TO the terms and conditions of a well agreement recorded in the above Clerk’s Office in Deed Book 335, Page 85.
The property shall be sold “AS IS” and the sale is subject to all restrictions, rights of way, conditions, easements, judgments, liens, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust, and to the real estate taxes from the date of the sale.
TERMS OF SALE: All cash. A deposit of $10,000.00 cash or by bank cashier’s check payable to the Trustee will be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the trustee’s compensation authorized by the deed of trust and the law in such cases.
Conveyance of the property shall be by trustee’s Special Warranty Deed. Except for the statutory grantor’s tax paid by the trustee, all costs of conveyance, including, but not limited to, examination of title, recording fees, and settlement fees, shall be at the cost of the purchaser.
The trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.

PUBLIC NOTICE
Notice is hereby given that Middlesex County Board of Supervisors has applied for a permit from the Marine Resources Commission to dredge 133 cubic yards of material from a 120-foot long by 20-foot wide area adjacent to a private pier owned by Paul Hilton at 131 Neptune Lane to remove two feet of material accidently deposited there during the Broad Creek Channel dredging project in 2010. The material will be removed hydraulically and pumped into a Geobag for dewatering on the Hilton property with ultimate disposal at the Broad Creek Dredge Storage site in Deltaville.

PUBLIC NOTICE
Notice is hereby given that Middlesex County Board of Supervisors has applied for a permit from the Marine Resources Commission to dredge 66 cubic yards of material from a 60-foot long by 20-foot wide area adjacent to a private pier owned by Guy Woodward next door to 131 Neptune Lane to remove 18 inches of material accidently deposited there as a result of the Broad Creek Channel dredging project in 2010. The material will be removed hydraulically and pumped into a Geobag container for dewatering on the Woodward property with ultimate disposal at the Broad Creek Dredge Storage site in Deltaville.

Notice is hereby given that Sarah Carneal has applied for a permit modification from the Marine Resources Commission to modify an existing breakwater and groin project to change an authorized 50-foot long timber groin to a stone structure with a 6-foot base width at property on the Piankatank River at 975 Wilton Creek Road in Middlesex County.
