In execution of the Deed of Trust from Hilda R. Faucett, dated June 8, 2008, securing the original amount of $110,000.00 and recorded as Instrument Numbered 080001485 in the Clerk’s Office of the Circuit Court of the County of Middlesex, Virginia, default having occurred and at the request of the holder, the undersigned, as Substitute Co-Trustees, either of whom may act, will sell at public auction at the front door of the Courthouse (Route 17 & 33 Courthouse), Saluda, Virginia, on August 19, 2016 at 11:00 a.m., the property known as 2702 Old Virginia Street, Urbanna, Virginia 23175 and more fully described as follows:
All of a certain tract, piece or parcel of land with improvements thereon, containing five (5) acres, more or less, lying in Saluda Magisterial District, Middlesex County, Virginia, situated on the left side of State Road No. 602, leading from Urbanna to Remlik, formerly known as Streets P.O.
The land herein conveyed is subject to a right of way twenty (20) feet wide running along the line of land now or formerly of Robert Fields leading from said main road to the lot of land now or formerly of James A. Jones, and for the benefit of said James A. Jones’ lot.
LESS AND EXCEPT that portion of property conveyed unto the Commonwealth of Virginia for the widening of State Route 602 by deed recorded in the aforesaid Clerk’s Office in Deed Book 80, Page 153.
The sale is subject to conditions, covenants, restrictions, reservations, party wall rights, easements, prior liens and other applicable matters of record.
TERMS OF SALE: CASH. A bidder’s deposit of the lesser of 10% of the bid amount, or $11,000.00, will be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. TIME IS OF THE ESSENCE. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the Trustee’s compensation authorized by law. Property sold as is, where is, without any duty of Trustee to obtain possession for purchaser.
Conveyance shall be by Special Warranty Deed. All costs of conveyance to be at the cost of purchaser. All real estate taxes and fees shall be prorated as of the date of sale.
The Trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.
