In execution of a certain deed of trust, to Kathryn Richards and Jerry B. Flowers, III, Trustees dated December 18, 2008, in the original principal amount of $75,000.00; recorded in the Clerk’s Office, Circuit Court of Middlesex County, Virginia, as Document #080-2779 and subsequently assigned to EVB by Document #080-2781, for whom W. All that certain piece or parcel of land, together with all improvements thereon, situated in Pinetop Magisterial District, Middlesex County, Virginia, lying in Section D of Piankatank Shores Subdivision, being Lot 14, the westernmost 20 feet of Lot 15 and the northernmost 60 feet of Woodstock Drive and containing 0.275 of an acre. For a more accurate and particular description as to the metes and bounds of the property hereby conveyed, reference is made to a plat of survey prepared by Dalton D. Brownley, Jr., L.S., dated November 30, 1998, entitled “Boundary Line Adjustment & Lot Line Vacation Survey for Justin A. Jessie,” a copy of which is of record in the Clerk’s Office of the Circuit Court, Middlesex County, Virginia and recorded in Plat Book 14, Page 210, whereon said plat the property hereby conveyed is shown and designated as ‘Lot 14 0.207 AC. 0.041 Ac, + 0.027 AC, 0.275 AC, Total, Part of Lot 15 0.041 ac and 0.027 ac.
Sale shall be made subject to all existing prior liens, easements and restrictive covenants as the same may lawfully affect the real estate. Terms of Sale: Cash. Settlement within 30 days of sale. A bidder’s deposit of 10% of the sale price will be required. The balance of the purchase price shall be in cash or its equivalent. Settlement shall be at the office of the Substitute Trustee or other mutually agreed location. The property and any improvements hereon shall be sold in “as is” condition without any warranties. The successful bidder shall assume all loss or damage to the property from and after the time of the sale. Purchaser shall be responsible for all costs of the conveyance, which shall be by special warranty. The sale is subject to such additional terms as the Substitute Trustee may announce at the time of sale. The Purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale.
Written notice of this Substitute Trustee’s Sale has been sent to the owners by certified mail in strict compliance with Section 55-59.1 of the Code of Virginia.
